Welcome to Plush Queen. "We", "us" and "our" refer to Plush Queen. We operate this store and website, including all related content, features, products and services (the "Services"). Plush Queen is powered by Shopify.

These Terms of Service ("Terms"), together with our Privacy Policy [LINK], describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about warranties and liability.

By using our Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where any part of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails.

1. Access and your account

By agreeing to these Terms, you confirm you are at least 18 years old (or have the consent of a parent or guardian). You're responsible for keeping your account details secure and for activity on your account. You may not transfer or sell your account to anyone else.

When you shop with us, you agree to provide accurate, current and complete information (such as your email, billing, payment and shipping details).

2. Our products

We do our best to represent our products accurately. As most of our items are pre-loved or vintage collectables, please note that colours and appearance may vary slightly from how they appear on your screen, and that condition is described honestly for each item on its product page.

We may change product descriptions, discontinue products, or limit quantities at any time.

3. Orders

When you place an order, you're making an offer to purchase. We may accept or decline any order at our discretion, and your order isn't accepted until we confirm it. We need to receive payment before accepting an order. As many of our items are one-of-a-kind, please check your order carefully — we may not be able to change it once accepted.

Returns and exchanges are handled under our Refund Policy [LINK], which sits alongside your rights under the Australian Consumer Law.

4. Prices and payment

Prices, discounts and promotions can change without notice. The price you pay is the price shown when you place your order, confirmed in your order confirmation email. Prices include GST where applicable. Shipping is calculated at checkout. International orders may attract import taxes or duties charged by the destination country — these are the buyer's responsibility.

You confirm that the payment details you provide are correct and that you're authorised to use them.

5. Shipping and delivery

Delivery times are estimates only and aren't guaranteed. We're not responsible for delays caused by carriers, customs, or events outside our control. Once we hand a parcel to the carrier, responsibility for it passes to you — though this doesn't affect your rights under the Australian Consumer Law if an item arrives damaged or not as described.

6. Intellectual property

The content on our Services — including text, images, graphics, logos and their arrangement — is owned by Plush Queen or its licensors and is protected by Australian and international intellectual property laws. You may use the Services for your own personal, non-commercial use only. You may not reproduce, distribute, modify or republish our content without our written permission.

"Plush Queen" and our logos are our trademarks and may not be used without our permission. Other names and logos on the Services belong to their respective owners.

7. Third-party tools and links

Our Services may include tools or links provided by third parties, which we don't control. These are provided "as is" and you use them at your own risk. Please review the third party's own terms before using them. We're not responsible for third-party websites or their content.

8. Relationship with Shopify

Plush Queen is powered by Shopify, which enables us to provide the Services to you. Any purchases you make are made directly with Plush Queen, not Shopify. You agree that Shopify isn't responsible for any aspect of sales between you and us, and you release Shopify and its affiliates from claims arising from your purchases with Plush Queen.

9. Privacy

All personal information we collect is handled under our Privacy Policy [LINK]. Because our Services are hosted by Shopify, some information is also handled under Shopify's Privacy Policy. By using the Services, you acknowledge you've read these policies.

10. Feedback

If you send us ideas, suggestions or reviews ("Feedback"), you grant us a royalty-free licence to use it to operate and improve the Services. We're not obliged to keep Feedback confidential, pay for it, or respond to it. You're responsible for your Feedback and confirm it doesn't infringe anyone's rights or contain anything unlawful.

11. Errors and corrections

Occasionally there may be typos, inaccuracies or omissions relating to descriptions, pricing, promotions or availability. We may correct these and change or cancel orders (including after you've ordered) if information was inaccurate, without prior notice.

12. Acceptable use

You may use the Services for lawful purposes only. You agree not to: use the Services unlawfully; infringe anyone's intellectual property; harass or harm others; transmit false information or spam; upload viruses or malicious code; scrape or extract data using bots or automated tools; or interfere with the security of the Services. We may suspend or terminate your access if you breach these Terms.

13. Termination

We may end your access to the Services at our discretion at any time. You'll remain responsible for any amounts owed up to that point. Sections that by their nature should continue (such as Intellectual Property, Liability, Indemnification and Governing Law) will survive termination.

14. Consumer guarantees, warranties and liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you're entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You're also entitled to have goods repaired or replaced if they aren't of acceptable quality and the failure doesn't amount to a major failure. Nothing in these Terms limits these rights.

To the extent permitted by law (and subject to the consumer guarantees above), the Services and products are provided on an "as is" and "as available" basis, and our liability for any claim is limited, at our option, to replacing the goods or supplying them again, or paying the cost of doing so. We're not liable for indirect or consequential loss to the extent the law allows us to exclude it.

15. Indemnity

You agree to indemnify Plush Queen and Shopify (and our respective affiliates) against claims, losses and reasonable legal costs arising from your breach of these Terms, your breach of the law or another person's rights, or your use of the Services — except to the extent caused by our own fault.

16. General

If any part of these Terms is found unenforceable, the rest continues to apply. Our not enforcing a right at any time doesn't waive it. These Terms are the entire agreement between you and us about the Services.

You may not transfer your rights under these Terms without our consent; we may transfer ours. These Terms are governed by the laws of Victoria, Australia, and you agree to the jurisdiction of the courts of Victoria.

17. Changes to these Terms

We may update these Terms from time to time by posting the updated version on this page. We'll let you know about material changes as required by law. Continuing to use the Services after changes are posted means you accept them.
